Welcome to www.kat.ae (the “Site”).

These Terms of Use and all policies and additional terms (if applicable) posted on the Site set out the terms on which we offer you access to and use of our Site, services, and applications, including our mobile application (collectively, the “Services”). All our policies and legal documents are incorporated by reference into these Terms of Use.

By accessing, registering, and/or continuing to use or access our Services, you are agreeing to be bound by these Terms of Use and the Legal Documents with immediate effect. These Terms of Use are subject to change by us at any time. Your continued use of the Site following any such change constitutes your agreement to these Terms of Use as modified.

1. About Our Site

The Site is an e-commerce platform that allows enterprise users to offer and sell products, and individuals and enterprise entities to buy products. We reserve the right to introduce new Services and update or withdraw any of the Services at our sole discretion, without liability.

2. Eligibility and Registration Requirements

You are eligible to register as a buyer or seller if you meet the following criteria:

  • For Buyers: You are above the legal age for purchasing products in your country of residence and can provide a delivery address in the United Arab Emirates (UAE) or other authorized regions.

  • For Sellers: You are a legal entity duly registered in your jurisdiction, hold a current trade license, and can provide proof of authorization for the individual registering the account along with valid identification and bank details.

We reserve the right to decline any registration without further explanation and to undertake necessary checks to verify your identity.

3. Your Obligations

When using the Services, you agree to:

  • Maintain the confidentiality of your account and password.

  • Provide true, accurate, and complete information.

  • Not disclose third-party user information provided to you.

  • Cooperate with requests for additional information regarding eligibility or usage.

Prohibited Content: You agree not to post or upload any content that is:

  • Blasphemous, defamatory, obscene, or racially/ethnically objectionable.

  • Culturally or religiously offensive or in violation of Islamic law, local rules, morals, and traditions.

  • Related to gambling, weapons, narcotics, or illegal chemicals.

  • Infringing on any third-party Intellectual Property Rights.

4. Intellectual Property Rights

Except for the rights expressly granted under these Terms:

  • All content on the Site (text, graphics, logos, images, software) is the property of KAT or its licensors.

  • You have no right to use any of our trademarks without our prior written consent.

  • Any content you provide in connection with the Services will become our property.

5. Warranties and Liability

  • Services “As Is”: Services are provided without representations or warranties of any kind. We do not warrant that product descriptions are accurate, complete, or error-free.

  • Limitation of Liability: To the extent permitted by law, KAT and its affiliates shall not be liable for loss of profits, data, or incidental/consequential damages.

  • Liability Cap: Our total liability for any claim is limited to the lower of: (a) the price the item sold for; (b) the total fees paid by you to us in the 12 months prior; or (c) AED 300.

6. Suspension and Termination

We may, at our sole discretion, limit, suspend, or permanently withdraw your access to the Services or cancel orders if:

  • We believe you have breached any term of these Terms of Use.

  • You are suspected of fraudulent activities or inventory abuse (e.g., bulk orders for commercial resale without authorization).

  • You use the platform for any unlawful purpose.

7. Cross-Border Transactions

For items shipped from outside the UAE:

  • The recipient is the “Importer of Record” and is responsible for all Import Charges (taxes, duties, and customs fees).

  • You authorize KAT or the Seller to designate a carrier to act as your agent with customs and tax authorities to clear your merchandise.

8. General Provisions

  • Governing Law: These Terms of Use are governed by and construed in accordance with the laws of the United Arab Emirates.

  • Dispute Resolution: Any dispute arising out of these Terms shall be referred to the competent courts of the UAE (or DIFC/ADGM if specifically applicable to the business registration).

  • Severability: If any provision is held to be invalid or unenforceable, the remaining provisions shall continue in full force.

  • Language: These terms are provided in both Arabic and English. In case of inconsistency, the version designated by the company (or the English version for technical/legal clarity) shall prevail.
